These terms set the ground rules for using ecomstart.io, a free publication about Shopify and starting an online business.

Acceptance of these terms

These Terms of Service ("Terms") govern your use of ecomstart.io and its subdomains (the "Site"), which is published by eComStart ("we," "us," or "our"), a brand of BSS Commerce. By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to use the Site.

What the Site offers

The Site publishes articles, guides, reviews, comparisons, checklists, and templates about Shopify, ecommerce, and small business topics. Everything on the Site is free to read and use. The Site has no user accounts, and it does not take orders or payments.

We may change, suspend, or remove any part of the Site, including any article or resource, at any time without notice.

Information only, not professional advice

The content on the Site is provided for general information and education. It is not legal, tax, financial, accounting, or other professional advice, and it does not take your personal circumstances into account. Before you make decisions about your business, speak with a qualified professional where appropriate.

We work to keep articles accurate and current, but we do not promise that they are complete, up to date, or error-free. Prices, plans, features, fees, trial terms, and promotions belong to the companies that offer them and change often. Check the provider's own website for current terms before you buy. Examples of revenue, margins, growth, or other results are illustrations only. We do not guarantee that you will make sales, earn income, or achieve any business outcome by following what you read here.

Affiliate links and commissions

Many pages contain affiliate links. If you click a link and then sign up for or buy a product or service, we may earn a commission from the company at no extra cost to you. Some of that tracking is done through affiliate networks such as Impact.com. Commissions help fund the Site, but we write our reviews and recommendations independently of them. Any transaction you make with a third party is between you and that party. Their terms, prices, refund rules, and privacy practices apply, and we are not a party to the transaction.

Intellectual property

The text, graphics, checklists, templates, layouts, and other content on the Site are owned by eComStart or its licensors and are protected by copyright and other laws. Names, logos, and trademarks of other companies, including Shopify, belong to their owners. We use them only to identify those companies and their products. The Site is independent and is not owned by, sponsored by, or endorsed by Shopify or any other company we write about, except for any disclosed affiliate relationship.

You may read the Site, download the free resources for your own personal or internal business use, and quote short excerpts with a clear link back to the original page. You may not copy, republish, resell, or redistribute our content or resources in bulk, remove copyright notices, or present our work as your own without our written permission.

Acceptable use

When using the Site, you agree not to:

• Break the law or infringe the rights of others
• Interfere with or disrupt the Site, its servers, or its security, or try to gain unauthorized access to any part of it
• Use automated tools, such as bots or scrapers, to copy content in bulk or to place a load on the Site that harms other readers
• Click affiliate links in a way that is fraudulent or misleading, or generate clicks or sign-ups artificially

Links to third-party websites

The Site links to websites, apps, and services that we do not own or control. We provide those links for convenience and are not responsible for their content, availability, accuracy, security, or practices. Visiting a linked site is at your own risk and subject to its own terms.

Store services and earlier orders

eComStart has offered prebuilt Shopify stores and Shopify store setup services. The Site does not take orders or payments for them. If you placed an order or agreed a project with us, the terms that applied when you bought, including the refund rules in our Refund Policy, continue to apply to that order or project unless we agreed otherwise in writing. Prebuilt store designs and customizations delivered under those orders were licensed for one-time use by the purchasing customer, and they may not be shared, resold, or redistributed without our written consent.

Disclaimer of warranties

The Site and everything on it are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components.

We are not responsible for the functionality, pricing, or availability of Shopify, third-party apps, themes, suppliers, or any other product or service we mention, or for issues on their platforms that affect your store or business.

Limitation of liability

To the fullest extent permitted by law, eComStart, BSS Commerce, and their owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Site or your reliance on its content, even if we have been told such losses are possible. Where liability cannot be excluded, our total liability for all claims related to the Site is limited to the greater of USD 100 or the amount you paid us for use of the Site, which is zero for free content. Nothing in these Terms limits any right you have under mandatory consumer protection law, or any liability that cannot be limited by law.

Indemnification

You agree to defend and hold us harmless from claims, damages, and expenses (including reasonable legal fees) that arise from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

Governing law

These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law principles. If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. Nothing in this section limits rights you may have under mandatory laws of the place where you live.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the latest revision. Your continued use of the Site after changes are posted means you accept the revised Terms.
